These Terms of Service ("Terms") govern your use of TheArchiveHollywood.com, our showroom services, our costume rentals, and your dealings with Marcosquared LLC, a California limited liability company doing business as The Archive Hollywood. By engaging with our services in any capacity, you agree to these Terms.

1. Eligibility

You must be at least 18 years of age, or the legal age of majority where you live, to rent from us or enter into any agreement with Marcosquared LLC.

2. Rentals are governed by the Rental Agreement

Every rental is governed by the Clothing & Costume Rental Agreement signed at pickup, together with the applicable invoice, condition record, any approved written addenda and any accepted Letter of Responsibility. Our Rental Terms page summarises that Agreement — rental periods and rates, fittings and holds, payment and security, collection and transport, care and cleaning, permitted use, cancellations, and how late returns, loss and damage are charged.

Where these Terms of Service and the signed Rental Agreement conflict, the Rental Agreement controls. Where the Rental Agreement and the invoice conflict, the Agreement controls, except as to item-specific pricing, rental dates and Agreed Loss Values, which are set by the invoice. Summaries published on this website are for convenience and do not modify the Agreement.

3. Client responsibilities

By using our services you agree to:

  • provide accurate contact and billing information;
  • inspect pieces at pickup and confirm their condition before leaving the showroom;
  • return pieces on time, in person, dry-cleaned, unaltered and in the condition they left;
  • use pieces only for lawful purposes and only as approved; and
  • not sub-rent, loan, transfer, copy, pattern, scan or reproduce any piece without our prior written consent.

Failure to comply may result in additional charges under the Rental Agreement, loss of rental privileges, or legal action.

4. Intellectual property

All photographs, video, designs, logos and marketing content produced by or for The Archive Hollywood remain the sole property of Marcosquared LLC unless otherwise agreed in writing. The garments themselves, and their design and construction, remain our property throughout the rental. Unauthorised use, duplication or reproduction — including patterning, scanning or copying a rented piece — is prohibited.

5. Limitation of liability

To the fullest extent permitted by law, Marcosquared LLC is not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits or reputational harm, arising from the use or misuse of our pieces or services. Pieces are provided as-is, with no warranty of fit, durability, performance or suitability for a particular production. Nothing here limits any liability that cannot lawfully be limited.

6. Assumption of risk and indemnification

You are responsible for determining whether each piece is appropriate for your intended use, performer, activity, environment and physical condition. To the fullest extent permitted by law, you assume the risks arising from your selection, fitting, wearing, handling, transport and use of rented pieces, except to the extent liability cannot lawfully be waived.

To the fullest extent permitted by law, you will defend, indemnify and hold harmless Marcosquared LLC and its owners, employees and agents from third-party claims, liabilities, losses, damages and reasonable costs arising from your or your representatives' possession, transport, alteration, misuse or use of rented pieces, except to the extent caused by conduct for which indemnification is prohibited by applicable law.

7. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted and apply to dealings from that date. They do not change the terms of a Rental Agreement already signed.

8. Governing law, venue and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any court proceeding arising from these Terms will be brought in a court of competent jurisdiction in Los Angeles County, California, and you consent to personal jurisdiction there. Nothing in these Terms prevents either party from bringing an eligible claim in small claims court, and these Terms contain no mandatory arbitration provision.
