Welcome to The Archive Hollywood. These Terms of Service (“Terms”) govern your use of our website, in-person showroom services, garment rentals, and all communications or interactions with Marcosquared LLC, a California limited liability company doing business as The Archive Hollywood. By engaging with our services in any capacity, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to rent garments or enter into any agreement with Marcosquared LLC. By using our services, you affirm that you meet this requirement.

2. Rental Services & Agreements

All rentals are subject to the terms outlined in our Return and Refund Policy, Rental Agreement, and Damage/Loss Policy, which are incorporated herein by reference. Clients agree to be bound by all signed or digital agreements and will be held liable for late returns, garment damage, unauthorized alterations, or lost items.

All rentals are final and non-refundable, as clearly communicated at the time of booking and pickup.

3. Client Responsibilities

By using our services, you agree to:

  • Provide accurate contact and billing information

  • Inspect items upon receipt and confirm their satisfactory condition

  • Return items on time and in original condition

  • Use the garments solely for lawful, agreed-upon purposes

  • Not sub-rent, loan, or transfer garments without written consent

Failure to comply with these responsibilities may result in additional charges, loss of rental privileges, or legal action.

4. Intellectual Property

All photos, videos, designs, logos, marketing content, and styling produced by or within The Archive Hollywood remain the sole property of Marcosquared LLC, unless otherwise agreed in writing. Unauthorized use, duplication, or reproduction of our intellectual property is strictly prohibited.

5. Limitation of Liability

To the fullest extent permitted by law, Marcosquared LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, reputational harm, or bodily injury, arising from the use or misuse of our garments or services.

Garments are provided as-is, with no guarantee of fit, performance, or compatibility with specific productions or client needs.

6. Indemnification

Clients agree to indemnify, defend, and hold harmless Marcosquared LLC, its owners, employees, and affiliates, from any claims, liabilities, damages, or expenses (including attorney’s fees) resulting from:

  • Misuse of rental items

  • Breach of these Terms

  • Third-party disputes relating to your use of our services or content

7. Modification of Terms

We reserve the right to modify or update these Terms at any time without prior notice. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

8. Governing Law & Venue

These Terms are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
